| 兩岸條例就強制大陸地區人民出境，未予申辯機會；又就暫予收容，未明定事由及期限，均違憲？ 強制出境辦法所定收容事由未經法律明確授權，亦違憲？ |
| [11]關於確立該項原則之意義，本席嘗於釋字第七Ｏ八號解釋「協同意見書」闡釋：「『法官保留』原則（事前的司法審查）乃關於『刑罰性質或因犯罪嫌疑』之人身自由限制的正當程序保障；『即時司法救濟』（事後的立即司法審查）乃關於『非刑罰性質或非因犯罪嫌疑』之人身自由限制的正當程序保障。釋字第六九Ｏ號解釋以來的『法官保留』原則零和選擇（全有或全無司法審查）的迷思於焉化解！」 [12]See International Covenant on Civil and Political Rights (ICCPR), §12: 1. Everyone lawfully within the territory of a State shall, within that territory, have the right to liberty of movement and freedom to choose his residence. 2. Everyone shall be free to leave any country, including his own. 3. The above-mentioned rights shall not be subject to any restrictions except those which are provided by law, are necessary to protect national security, public order (ordre public), public health or morals or the rights and freedoms of others, and are consistent with the other rights recognized in the present Covenant. 4. No one shall be arbitrarily deprived of the right to enter his own country. (emphasis added) See also ICCPR, General Comment No. 15(1986/04/11) § 6: Consent for entry may be given subject to conditions relating, for example, to movement, residence and employment. A State may also impose general conditions upon an alien who is in transit. However, once aliens are allowed to enter the territory of a State party they are entitled to the rights set out in the Covenant.(emphasis added) [13]參見本院釋字第四九七號解釋（「內政部依該（兩岸關係）條例第十條及第十七條之授權分別訂定「大陸地區人民進入臺灣地區許可辦法」及「大陸地區人民在臺灣地區定居或居留許可辦法」，明文規定大陸地區人民進入臺灣地區之資格要件、許可程序及停留期限，係在確保臺灣地區安全與民眾福祉，符合該條例之立法意旨，尚未逾越母法之授權範圍，為維持社會秩序或增進公共利益所必要，與上揭憲法增修條文無違，於憲法第二十三條之規定亦無牴觸」）、第五五八號解釋（「依現行憲法增修條文第十一條規定，自由地區與大陸地區間人民權利義務關係及其他事務之處理，得以法律為特別之規定，是法律就大陸地區人民進入臺灣地區設有限制，符合憲法上開意旨」）。 [14]所謂「經許可合法入境」之大陸地區人民，係指：「形式上業經主管機關許可」且「事實上已合法入境台灣地區」之大陸地區人民（本號解釋之解釋理由書第二段參照）。準此，兩岸關係條例第十八條第一項第一款所謂「未經許可入境」之典型情形（例如偷渡入境者），受強制出境時仍無本號解釋所揭示之正當法律程序之適用。但如本案聲請人（梁○）曾「經許可合法入境」，嗣後入境許可遭撤銷，則非屬「未經許可入境」之情形。質言之，本號解釋對於所謂「未經許可入境」採取合目的性之限縮解釋！ |
